Terms of Service

1. Agreement to Terms

By creating an account or using Construction Prism (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms apply to the web app and the mobile app.

2. The Service

Construction Prism converts a written construction scope of work into a priced, line-item estimate using an AI-assisted, three-pass pipeline (parse, price, gap-check), tagged with confidence flags. Exports are available in XLS, CSV, PDF, Share Link formats, and estimates can be shared via a public read-only link.

3. Accounts

You sign in with Google (and, where available, Sign in with Apple). You must provide accurate account information and are responsible for keeping your sign-in credentials secure. You are responsible for all activity under your account.

4. Subscriptions, Trial & Credits

A free trial is available and does not require a credit card. After the trial, the Service is offered as a paid subscription: 20 USD/month for 30 estimates, or 200 USD/year for 360 estimates. Additional one-time credit packs can be purchased on top of a subscription. Subscriptions are billed and managed through Stripe, renew automatically at the end of each billing period unless canceled, and can be canceled at any time from the billing portal in the app — cancellation takes effect at the end of the current billing period. Except where required by law, fees already billed are non-refundable.

5. Estimates Are Advisory, Not a Guarantee

This is the most important section. Construction Prism is a starting point, not a substitute for professional judgment.

• Every line item carries a confidence flag — HISTORICAL (a known rate from your own data), AI-BENCHMARK or AI-INFERRED (an AI-estimated rate that should be reviewed), or NEEDS QUOTE (no reliable basis — get a real quote). These flags exist because the AI is expected to be wrong sometimes, and the product is designed to surface exactly where.
• You (or your company) are solely responsible for reviewing, adjusting, and validating every price, quantity, and line item before it is used in a bid, contract, client proposal, or any other binding document.
• Construction Prism makes no warranty, express or implied, that any estimate is accurate, complete, or suitable for a particular project, and is not liable for cost overruns, bid losses, missed scope, or any other outcome resulting from reliance on an estimate without independent professional review.

6. Your Data & Content

You retain ownership of the scope-of-work text, project data, and pricing you submit. You grant us a license to process that content solely to provide the Service to you, including sending scope-of-work text to our AI processor as described in the Privacy Policy. You are responsible for having the right to submit any content you upload.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to reverse-engineer, scrape, or extract the underlying pricing engine, AI prompts, or cost-code data.
• Resell or provide third-party access to the Service without our written consent.
• Abuse rate limits, attempt to circumvent credit/token metering, or interfere with the Service's operation.
• Upload content you do not have the right to submit, or impersonate another person or company.

We may suspend or terminate accounts that violate this section.

8. Intellectual Property

Construction Prism, its software, pricing algorithms, cost-code translation logic, and branding are owned by us and protected by intellectual property law. Nothing in these terms transfers ownership of the Service to you. If you send us feedback or suggestions, you grant us the right to use them without restriction or compensation.

9. Third-Party Services

The Service relies on third-party providers — including Stripe (payments), Google and Apple (sign-in), Anthropic (AI processing), PostHog (analytics), Crisp (support chat), Sentry (error monitoring), and Resend (email) — each governed by its own terms and privacy policy. We are not responsible for the availability or conduct of these third-party services.

10. Disclaimers & Limitation of Liability

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. To the maximum extent permitted by law, Construction Prism and its founder are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising from your use of the Service — including reliance on any estimate. Our total liability for any claim arising out of these terms or the Service is limited to the amount you paid us in the 12 months preceding the claim.

11. Termination

You may stop using the Service and delete your account at any time — see Account Deletion. We may suspend or terminate your access for violation of these terms, non-payment, or extended inactivity, with notice where practical.

12. Changes to These Terms

We may update these terms as the product changes. Material changes will be reflected by an updated "Last updated" date at the top of this page. Continued use of the Service after a change constitutes acceptance of the updated terms.

13. Governing Law

These terms are governed by the laws of the State of Oregon, USA, without regard to its conflict-of-laws principles, unless a different jurisdiction is required by applicable law.
